SECTIONS OF STATUTES AND RULES INVOLVED Count I Pursuant to Iowa Administrative Code 645—282.2(8)(b)(2), Respondent is charged with engaging in an impermissible professional conflict of interest. Count II Pursuant to Iowa Administrative Code 645—283.2(2)(c), Respondent is charged with professional incompetency for a failure to exercise the degree of care which is ordinarily exercised by the average social worker acting in the same or similarcircumstances. Count III Pursuant to Iowa Administrative Code 645—283.2(2)(d), Respondent is charged with professional incompetency for a failure to conform to the minimal standard of acceptable and prevailing practice of licensed social workers in this state. Count IV Pursuant to Iowa Administrative Code 645—283.2(12), Respondent is charged with violation of a regulation, rule, or law of this state which relates to the practice of social work, including, but not limited to, the rules of conduct found in 645—282.2 D. FACTUAL CIRCUMSTANCES 1. Respondent provided clinical services to a minor client in 2010. Respondent is a mandatory reporter of child abuse under Iowa law but failed to timely report suspected abuse of her minor client. 2. Respondent engaged in personal email conversations with her minor client, exchanged gifts with her client, and permitted the minor client to negotiate guidelines for the therapeutic relationship which restricted Respondent’s communication with the client’s parents. 3. Respondent contacted her minor client after the termination of their social worker-client relationship, without a release or the permission of the minor client’s parents. 4. Respondent failed to inform the minor client’s parents of Respondent’s concerns for the client’s safety and the client’s disclosures of self-harming behavior.
